LUVAÉ Returns & Refunds Policy
1. Applicability & Overview
- This Returns & Refunds Policy applies to purchases made through LUVAÉ’s U.S. online store (or U.S. customers).
- This policy supplements (and does not replace) consumer rights under applicable state or federal law (e.g. for defective or nonconforming goods).
- While there is no federal law mandating a “change-of-mind” return period, once LUVAÉ publishes a returns policy, we are legally bound to follow it.
- If any state law requires more generous rights, those legal rights will govern for customers in that state.
2. Return Window / Eligibility
- You may return most items within 30 days of the date you (or your designated recipient) receive the order, for a full refund (subject to the conditions below).
- To initiate a return, you must notify us via our returns portal (or by email) and follow our return instructions.
- All returned items must be in their original, unused, unwashed condition, with all original tags, packaging, and accessories intact.
- Items that show signs of wear, damage, stains, odors, or that are missing tags or original packaging may be refused or subject to partial refunds at our discretion.
- Some items may be non-returnable (for hygiene or safety reasons). You must clearly list such items (e.g. underwear, swimwear, face masks, custom or personalized goods) in this policy and on the product pages.
3. Return Shipping & Costs
- The customer is responsible for the cost of return shipping, unless we explicitly offer prepaid return labels or free returns for your order.
- We recommend using a trackable shipping method and retaining proof of postage.
- In the event that we provide a prepaid return label, we may deduct the cost from your refund (or limit that option to certain orders).
- If the return is due to our error (e.g. wrong item shipped, defective product), LUVAÉ will cover the return shipping cost (or reimburse you).
4. Refunds & Timing
- Refunds will be made via the original payment method used in the purchase (credit card, debit card, gift card, etc.).
- If the purchase was made partially with a gift card or store credit, applicable amounts will be refunded to those sources first.
- We will process the refund as soon as possible, and in any case within 14 days after we receive the returned item(s).
- Please allow additional time for your bank or card issuer to post the refund to your account.
5. Exchanges
- If you wish to exchange an item for a different size, color, or variant, please initiate a return of the original item and place a new order (or use our exchange flow, if available).
- Exchanges are subject to availability.
- If we offer free exchanges for identical items (same style, just different size), we may cover shipping for sending the replacement, but return shipping of the original item will still be your responsibility unless otherwise stated.
6. Defective, Damaged, or Incorrect Items
- If you receive a defective, damaged, or incorrect item, contact us within [7 / 14] days of delivery and provide evidence (photos, description).
- We will offer either a full refund or a replacement (at your choice), at no extra cost to you (including return shipping).
- This does not limit your rights under state warranty or consumer protection laws.
7. Refund Reductions & Discount Codes
- If you used a discount code or promotional offer, the refund may be adjusted to reflect the proportionate discount you received.
- We deduct the same discount proportionately from the refunded amount.
- Shipping charges originally paid (if non-refundable) may not always be refunded, depending on how they were billed.
8. Restocking Fees
- Unless stated otherwise, we do not charge restocking fees.
- If we elect to impose a restocking fee (for example, for bulky or special‐order items), it must be disclosed clearly in this policy and on the product page before purchase.
- Where such a fee applies, it will be deducted from your refund.
9. Conditions & Exceptions
- Returns must be authorized prior to shipping back—unauthorized returns may be refused or incur fees.
- We reserve the right to refuse returns that do not meet the above conditions.
- In case of lost return shipments, you must provide proof of shipment; we are not responsible until we receive the item.
10. How to Return / Process
- Visit our Return Portal or contact us at [support@luvae.com] to initiate a return.
- Fill in your order number, item(s) to return, reason, and whether you want a refund or exchange.
- We will send you instructions and (if applicable) a prepaid return label.
- Pack the item securely in original packaging, attach the label, and ship via the carrier.
- Once we receive and inspect the return, we’ll process your refund or ship your exchange.
11. Policy Disclosure & Visibility
- This Returns & Refunds Policy must be displayed conspicuously on LUVAÉ’s website (e.g. linked in the footer, on checkout pages, and on product pages).
- If we adopt any variation (e.g. a shorter return window for certain items or during sales), the variation must be clearly disclosed in advance (e.g. “sale items final sale” or “no returns after 15 days”).
- Failure to clearly post a return policy in certain states may result in default consumer rights (for example, in some states an unposted policy might mean customers can return within 30 days).
12. Additional Rights & State Laws
- This policy does not limit consumer rights provided by state laws (e.g. for defective or misrepresented goods).
- In states that require a minimum refund timeframe or specific disclosure (e.g. Minnesota, New York, California), those statutory standards will override any conflicting term here.
- If a court deems any clause invalid under state law, the remainder of the policy remains in effect.
13. Changes to This Policy
- LUVAÉ reserves the right to modify or replace this Returns & Refunds Policy at any time.
- All changes will take effect upon posting to our site with a revised “Effective Date.”
- Your continued purchases after changes constitute your acceptance of the new policy.
